Terms of Service

These Terms of Service ("Terms") govern your use of the services provided by Air Exchange Mechanical Ltd. ("we", "us", or "our") as an HVAC company. By accessing or using our services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our services.

· We politely request at least 24 hours' notice for cancellations or re-scheduling.

· Last-minute cancellations will be subject to a small $35.00 fee to cover scheduling costs. 

· Payment is due at the time of service & billing.

· We do not accept cash.

· We accept online payments (3% fee applies)

· Automatically deposited e-transfer to: ap@airexchange.ca

Scope of Services

Our services include but are not limited to HVAC installation, repair, maintenance, and consultation. We strive to provide these services with professionalism and expertise.

Service Estimates and Quotes

All estimates and quotes provided by us are based on the information available at the time of assessment. Actual costs may vary depending on factors discovered during the course of the service. We reserve the right to adjust estimates and quotes accordingly.

Service Terms and Conditions

• We will perform services in a timely and professional manner, adhering to industry standards and best practices.
• Any changes to the scope of work must be agreed upon by both parties in writing.
• Payment terms are as agreed upon in the service contract or invoice. Payment is due upon completion of the service unless otherwise specified.
• We reserve the right to refuse service to any individual or property deemed unsafe or unsuitable for service.

Warranty and Liability
By requesting and permitting Air Exchange Mechanical (The Company) to perform HVAC inspection, maintenance, repair, or installation services at your property, you acknowledge and agree to the following terms:

Pre-Existing Conditions:
The Company is not responsible for any damage, failure, or malfunction resulting from pre-existing structural issues; aging, deteriorated, or improperly installed HVAC components; lack of maintenance; code violations; unsafe property conditions; or any other defects that existed prior to our arrival.

System Condition and Performance:
Mechanical systems have finite lifespans. The Company cannot guarantee the continued performance, reliability, or remaining life expectancy of any HVAC equipment that is old, poorly maintained, near failure, or operating outside of manufacturer specifications.

Incidental Damage:
The Company is not liable for incidental or consequential damages, including but not limited to water damage, electrical issues, environmental hazards, or secondary component failures that occur during or after service as a result of the system’s pre-service condition.

Access and Property Risks:
Customer is responsible for providing safe, unobstructed access to the equipment. The Company is not liable for damage caused by unsafe work environments, unstable structures, hazardous materials, pest infestations, or other unsafe property conditions encountered during service.

Financial Conditions of Property:
The Company makes no warranties or assurances related to insurance coverage, property value, compliance status, or the financial condition of the property. Any recommendations or service decisions are based solely on the condition of the equipment inspected.

Approval of Work & Assumption of Risk:
By approving the proposed work, the customer assumes all risks related to servicing aged, failing, or non-code-compliant systems and acknowledges that additional repairs or replacement may be required.

Limited Warranty on Workmanship:
The Company warrants its workmanship as specified in the service agreement. This warranty does not cover failures caused by pre-existing issues, misuse, lack of maintenance, or equipment age. 

Intellectual Property

All content, including but not limited to logos, trademarks, and written materials, are the property of  Air Exchange Mechanical Ltd. and may not be used or reproduced without permission.

Privacy Policy

We respect your privacy and are committed to protecting your personal information. Our Privacy Policy outlines how we collect, use, and disclose personal information in accordance with applicable privacy laws.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of [Your Province], Canada, without regard to its conflict of law provisions.
